Terms of Service

The rules for using Keypoint Lens: what the service does, plans and billing, acceptable use, each party’s responsibilities and how to close your account.
1. Who we are and acceptance of these terms
Keypoint Lens (“Lens”, the “Service”) is provided by KEYPOINT SOLUÇÕES EM TECNOLOGIA LTDA (“Keypoint”, “we”, “us”), CNPJ registration in progress, headquartered at Goiânia/GO, Brazil. The Service is available at app.keypointec.com.
By creating an account, buying a plan or using the Service, you (the “Customer”) confirm that you have read and agree to these Terms of Service, the Privacy Policy, the Cookie Policy, the Data Processing Agreement (DPA) and the Refund and Cancellation Policy, which are part of this contract. If you sign up on behalf of a company, you confirm that you have authority to bind it.
2. What the Service is
Lens is an analytics platform for people who run paid traffic. Together, its features let you:
- track sales from the ad to the paid order, using webhooks sent by the Customer’s checkout and Meta Ads data read through OAuth authorization;
- record browsing sessions on the Customer’s websites with our own recorder (clicks, scroll, rage clicks and dead clicks, JavaScript errors and performance);
- build funnels, dashboards and alerts;
- analyze sessions with artificial intelligence, producing summaries and suggestions;
- access your data through an API and MCP once these features launch (coming soon; Pro and Scale plans);
- connect WhatsApp Business numbers exclusively through the official WhatsApp API.
We may improve, adjust or discontinue features. Changes that materially reduce what you purchased follow the “Changes to these terms” section.
3. Account and eligibility
- The Service is intended for people aged 18 or over, and for businesses or professionals acting in a business capacity.
- You must provide accurate information and keep it up to date, including the details needed to issue an invoice.
- You are responsible for keeping your credentials, API/MCP keys and tokens confidential, and for everything done with them. We recommend enabling two-factor authentication (2FA).
- Each account has one owner. Collaborators you add act under your responsibility.
- You can sign in with e-mail and password, “Sign in with Google” or “Sign in with Apple”.
4. Plans and prices
Every new signup starts on the Free plan, with no card required and no expiry. Paid plans start when the first payment is confirmed. There is no trial period for paid plans.

Customers paying in Brazil are billed in Brazilian reais (the R$ amounts above); international customers are billed in US dollars. Annual billing means you pay for 10 months and use 12.
Add-ons (billed in Brazilian reais; the amount in your billing currency is shown in the app before you buy): R$ 19.90 per pack of 20 thousand sessions; R$ 9.90 per additional collaborator or account; R$ 19.90 per additional WhatsApp number. Sales tracking is unlimited on every plan.
Active subscriptions keep the contracted price. Any price change is notified 30 days in advance and applies only from the renewal following the notice.
5. Payment and billing
- In Brazil we bill through Asaas Gestão Financeira S.A.: recurring card, PIX and boleto. Boleto and up to 3 interest-free installments are available only on the annual plan (installments by card only).
- Outside Brazil we bill through Stripe, Inc.: cards, Apple Pay and Google Pay.
- Keypoint never receives or stores your full card number; payment data is tokenized by the payment gateway.
- We issue NFS-e (Brazilian electronic service invoices) for payments made in Brazil, using the tax details you provide.
- Failed payments: we retry on days 3, 5 and 7 after the due date. After a 7-day grace period without payment, the account moves to the Free plan. Data beyond the Free plan retention is kept for 30 days (it comes back if you reactivate) and then follows the Free plan retention.
- Upgrades take effect immediately with a pro-rata charge for the rest of the cycle. Downgrades take effect at the end of the paid cycle; data beyond the new plan’s retention is not deleted right away: it is kept for 30 days (it comes back if you return to the previous plan) and then follows the new plan’s retention.

6. Session quota and usage limits
Each plan includes a monthly number of recorded sessions. When the quota is used up, recording of NEW sessions stops until the next cycle (or until you buy an add-on); sales tracking continues as normal. Sessions already recorded remain available for the plan’s retention period.
We may apply reasonable technical limits (for example, API request rates) to protect the stability of the Service.
7. Cancellation, pause and closure
- You can cancel at any time in the dashboard. Access continues until the end of the period already paid.
- Pause: you can pause your subscription for up to 3 months at no charge; while paused, the account is read-only.
- Refunds: as set out in the Refund and Cancellation Policy (full refund within 7 days of the first purchase).
- After cancellation or closure, your data is archived for 30 days and then permanently deleted, with a notice 1 day before. You can export it before then.
- We may close an account for a serious breach of these terms, with notice where possible.
8. Acceptable use
You agree not to:
- install the recorder on websites where you have no lawful basis for the processing, or without properly informing visitors;
- record sensitive categories of data (for example health, biometrics, racial or ethnic origin, beliefs, sex life), or card data, passwords or ID documents — fields of that kind are masked by default and you must not disable that protection;
- use the Service for illegal content, fraud, scams, spam or infringement of third-party rights;
- scrape the Service or extract data from it by unauthorized means;
- reverse engineer, decompile or try to access the source code, or bypass limits and security measures;
- resell or sublicense the Service without a written agreement with us;
- use the Service in a way that harms the security or availability of other customers.
In case of abuse, Keypoint may suspend the account in whole or in part, immediately and without prior notice where there is risk to third parties, to the Service or a legal obligation, and will state the reason as soon as possible.
9. Customer responsibilities regarding visitor and buyer data
For the data of visitors and buyers of your websites, you are the controller and Keypoint acts as processor under the Data Processing Agreement (DPA). You are responsible for:
- having a lawful basis for the processing (LGPD art. 7; GDPR art. 6 where applicable) and informing visitors about session recording and browsing analytics in your own privacy policy (a template is provided in “Policy template”);
- maintaining your own cookie banner or notice and, where needed, configuring the recorder to wait for consent;
- handling data subject requests, with our assistance;
- making sure the data sent to Lens is adequate and necessary for the purpose.
10. Support and staff access to your account
Support is provided at [email protected]. To help with a ticket, our team may use the “Enter as customer” function. That access always notifies you, is read-only and shows buyers’ personal data masked.
11. Intellectual property and Customer data
The software, brand, interface and documentation of Lens belong to Keypoint. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service during the contract.
The data you send or that is collected on your websites remains yours. You authorize us to process it only to provide the Service, under the DPA. We may use aggregated, non-identifiable data for statistics and product improvement.
12. Availability and limitation of liability
- The Service is provided “as is”. We make our best effort to keep it available and publish its status on a status page, but we do not guarantee uninterrupted availability and there is no SLA unless agreed in writing.
- AI analysis and metrics are decision support; they may contain inaccuracies and do not replace your own judgment.
- To the maximum extent permitted by law, Keypoint’s total liability to you is limited to the amounts you paid in the 12 months before the event giving rise to the claim.
- Keypoint is not liable for indirect damages, lost profits or loss of business opportunity.
- Nothing in these terms excludes liability that cannot be excluded by law, including consumer rights under the Brazilian Consumer Defense Code (CDC).
13. Changes to these terms
We may update these terms. For material changes we will notify you by e-mail or in the app 30 days in advance. If you do not agree, you may cancel before the change takes effect; continued use afterwards means acceptance. Formal corrections and changes that do not harm your rights may take effect immediately.
14. Governing law, venue and contact
These terms are governed by the laws of Brazil. The courts of Goiânia/GO have jurisdiction over disputes; where the Customer is a consumer, the courts of the consumer’s place of residence apply, as provided by the CDC.
Users in the European Union or the United Kingdom keep the rights granted to them by the GDPR (or UK GDPR), and California residents keep their rights under the CCPA, as described in the Privacy Policy. Nothing in these terms limits mandatory rights under the law of your country of residence.
